No lawyer relishes the thought of a negligence claim which may affect his or her professional reputation. We well understand that a professional negligence claim has implications not restricted to the financial and our clients tell us that they particularly appreciate the partner-led service that we offer in this field.
If a transaction has gone awry, we will always consider whether a potential loss can be mitigated and work with our clients to formulate a mitigation strategy for example by rectification, deed of variation, the application of the principle in Hastings-Bass or by involving other responsible parties. In this way, it is often possible to avoid a formal claim. If a claim results nonetheless, we will explore every avenue open to recover any sums that may be paid out by insurers.
Our experience of acting for solicitors in England and Wales extends back to the days of the Master Policy and subsequently the Solicitors' Indemnity Fund and includes:
- Mortgage frauds. We have handled multiple claims involving rings of professionals and money launderers as well as one-off frauds some of which have been for eight figure sums. We act on some of the largest notifications currently made to the market involving claims up to £100 million and blanket notifications of over 1000 transactions
- Property claims arising from substantial developments resulting in multi-party disputes, including one for £75 million
- Substantial loss of chance claims arising from alleged failures properly to conduct litigation
- 100% success record in defending claims in the wasted costs jurisdiction
- The Accident Group (TAG) litigation involving substantial multi-party claims and managed litigation
- Complex claims against solicitors arising from PFI projects
